Company is already fighting legal action over April hacks

A gamer in North Carolina has filed a lawsuit against video game hardware maker and publisher Sony, claiming that the company used business practices when it introduced a new provision in the Terms of Service for the PlayStation 3 that accompanied the most recent firmware update.

Another similar legal action stated that Sony was unfair in asking players to accept the new ToS or forgo access to the PlayStation Network but a federal judge has dismissed it because of lack of evidence against the video game company.

Microsoft has also added a provision that bars users from launching lawsuits against the company in the updated ToS that was linked to the recent dashboard update.

Companies are interested in limiting their liability after Sony was hit with more than 50 lawsuits because of the breach in security that happened in April, leading to the theft of personal information including credit card account data.
